Terms and Conditions of Business

| The
prices shown in the latest catalog shall be applicable. All
prices indicated in the catalog are net excluding the statutory
value-added tax currently applicable. |
Germany:Postage
is charged according to weight plus 1,50 Euro forwarding expenses.
Should boxes for dangerous goods be required, these will be
charged at 8,-- Euro each.
Foreign countries: Postage is charged according
to weight plus 5,-- Euro forwarding expenses. Should boxes
for dangerous goods be required, these will be charged at
8,-- Euro each. |
| A
small order surcharge of 5,00 EUR shall be charged for orders
below 30,00 EUR. |
Germany
and EU: Invoices are payable within 14 days net cash.
Other countries: Advance payment or according
to prior agreement. |
Invoice,
payment by automatic debit transfer (only within Germany)
or cash on delivery.
Credit cards: Visa, Eurocard, Diners and Mastercard. |
A
processing fee of 3,-- Euro shall be charged per reminder
if there is a delay in payments.
Additionally, default interest at the legally permissible
rate shall be charged after failure to pay on due date. |
| All
goods delivered shall remain the property of Hammerl GmbH
& Co. KG until full payment has been made. It is prohibited
to transfer ownership of the goods or to assign these by way
of security to a third party before full payment has been
effected. The goods delivered shall be conveyed at the risk
of the consignee. |
| Reservation
of right of modification |
| Please
note that the prices for resins and colored resins may be
subject to price fluctuations. For this reason the valid daily
prices shall always be charged. |
| Keep
varnishes away from heat and fire and ensure good ventilation.Take
precautionary measures to avoid inhaling fumes. Avoid skin
and eye contact. It is essential that spirit varnishes and
varnishes with propolis additive are refilled into glass bottles
after delivery. We must forward varnishes in metal containers
due to forwarding regulations. |
| Place
of performance and jurisdiction |
| The
place of performance for deliveries is D-91083 Baiersdorf.
In case of disputes, the courts at D-91052 Erlangen have jurisdiction
and venue. The contractual relations between the parties shall
be governed by and construed in accordance with the laws of
the Federal Republic of Germany exclusively. Any application
of the laws on the international sale of goods is precluded. |
| Turnover
tax identification number for customers from the EU |
| Please
indicate on the first order whether you have a turnover tax
identification number. The German value added tax is not applicable
if you have a turnover tax ID number. However, if you do not
have a turnover tax identification number, we must charge
you with the German statutory value-added tax in addition
to the price shown in the catalogue. This provision is only
applicable to customers from the member states of the EU.
Value-added tax is not applicable for exports to any other
countries |
